TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern the tutoring, assessment, educational and related services provided by Naijatutors Konnect (“Naijatutors”, “we”, “us” or “our”).
By registering a student, purchasing a service, booking or attending a class, or otherwise using our services, you agree to these Terms.
Where a student is under 18, the parent or legal guardian registering the student enters into this agreement on the student’s behalf and is responsible for payments and compliance with these Terms.
1. OUR SERVICESNaijatutors Konnect provides online educational services to children and young people.
Our services may include:
private one-to-one tutoring;
group tutoring;
academic assessments;
examination preparation;
subject tutoring;
language programmes;
coding and skills programmes;
holiday and enrichment programmes;
educational consultations; and
other educational programmes offered from time to time.
Most Naijatutors services are delivered online.
2. REGISTRATION & PARENT
RESPONSIBILITYStudents under 18 should normally be registered by a parent or legal guardian.
By registering a child, you confirm that:
you are authorised to arrange tutoring for the child;
the information you provide is accurate;
you will provide information reasonably necessary for us to support the student’s learning;
you will ensure the student has appropriate technology and internet access;
you will ensure the student attends scheduled lessons; and
you are responsible for fees relating to the student’s enrolment.
Parents should notify Naijatutors if important information affecting the student’s learning, scheduling or safeguarding changes.
3. ASSESSMENT &
TUTOR MATCHINGWe may recommend an academic or diagnostic assessment before a student begins tutoring.
Assessments may be used to:
identify the student’s current level;
identify strengths and learning gaps;
recommend an appropriate programme;
establish learning goals; and
assist with tutor matching.
We aim to match students with tutors based on factors such as:
subject;
curriculum;
academic level;
learning needs;
teaching style;
availability; and
tutor experience.
A particular tutor cannot be guaranteed.
Naijatutors may change a student’s tutor where reasonably necessary, including because of tutor availability, scheduling, quality concerns, safeguarding considerations or where we believe another tutor would better support the student.
Where possible, we will provide reasonable notice and arrange a suitable replacement.
4. PRIVATE & GROUP CLASSESPrivate Classes
Private tutoring is normally provided on a one-to-one basis and can be adapted to the student’s individual learning needs.
Group Classes
Group classes may include up to four students, unless a programme is specifically advertised with a different group size.
Students within a group may have different strengths, learning styles and academic needs.
Although tutors will make reasonable efforts to support individual students, group classes cannot provide the same level of individualisation as private tutoring.
Unless otherwise stated, standard tutoring sessions are normally 60 minutes.
5. SCHEDULING
& ATTENDANCELessons are scheduled based on:
student availability;
tutor availability;
programme requirements; and
the timetable agreed with the parent.
Parents are responsible for checking confirmed class times, including any time-zone differences.
Students should join lessons on time and be ready to participate.
7-Minute Wait Rule
If a student has not joined a scheduled lesson, the tutor will normally remain available for at least 7 minutes after the scheduled start time.
If the student does not attend and the parent has not contacted us, the lesson may be recorded as a no-show.
Where a student joins late, the lesson will normally still finish at the originally scheduled time.
If a tutor is late and the delay materially reduces teaching time, Naijatutors will take reasonable steps to provide the missing time, reschedule the affected portion or provide another appropriate remedy.
6. FEES & PAYMENTFees will be communicated before the relevant service is confirmed.
Fees may vary depending on:
private or group tutoring;
programme;
subject;
frequency;
duration;
country;
currency; and
any applicable promotion.
Unless otherwise agreed, tutoring services are provided on a prepaid basis.
Invoices must be paid by the stated due date.
Payment may be collected through payment methods offered by Naijatutors, including authorised third-party payment processors.
Where recurring payment or direct debit has been authorised, the applicable payment may be collected in accordance with that authorisation.
If payment remains overdue after reasonable notice, Naijatutors may suspend future lessons until the account is brought up to date.
We may change our fees from time to time but will provide reasonable notice before changes affecting ongoing tutoring take effect.
7. CANCELLATION
& COOLING-OFF RIGHTSNothing in these Terms removes any statutory cancellation or consumer rights that apply to you.
For example, where UK consumer law applies to an eligible service purchased online, a customer will generally have a 14-day cancellation period beginning after the service contract is entered into.
If you ask us to begin tutoring during a statutory cancellation period and subsequently cancel, you may be required to pay for services already provided, where permitted by law.
If the service has been fully performed during the cancellation period following the appropriate request and acknowledgement, the statutory cancellation right may end where permitted by law.
Ongoing Tutoring
For an ongoing tutoring arrangement, parents should normally give Naijatutors at least 14 days’ written notice if they wish to:
stop tutoring;
pause tutoring; or
make a significant change to the ongoing arrangement.
This operational 14-day notice period is separate from any statutory cooling-off rights available under applicable consumer law.
Fees relating to lessons properly scheduled during the notice period may remain payable where reasonable and legally permitted.
Where a customer has prepaid for services that will not be provided and Naijatutors is not legally entitled to retain the payment, the appropriate unused amount will be refunded or credited.
8. RESCHEDULING
& MISSED PRIVATE CLASSESA private lesson may be rescheduled where the parent provides at least 4 hours’ notice before the scheduled lesson time.
Where sufficient notice is provided:
we will make reasonable efforts to reschedule the lesson;
the alternative time is subject to tutor availability; and
the make-up lesson should normally take place within 7 days of the original lesson.
Where less than 4 hours’ notice is provided, or a student fails to attend, the lesson may be treated as delivered and the fee may not be refundable because the tutor’s time was reserved for that student.
Exceptions may be considered in genuine emergencies or exceptional circumstances.
This policy does not affect statutory consumer rights.
9. GROUP CLASS ABSENCESGroup classes operate according to a scheduled timetable.
If a student misses a group lesson:
the class will continue for the other students;
an individual make-up lesson will not normally be provided; and
the missed class will not normally be refundable.
Where appropriate and available, we may provide class materials or assignments to assist the student in catching up.
10. CANCELLATIONS
BY NAIJATUTORSIf Naijatutors or the tutor cannot provide a scheduled lesson, we may:
reschedule the lesson;
provide an appropriate replacement tutor;
provide a class credit; or
refund the affected lesson where appropriate.
A parent will not be charged for tutoring that Naijatutors fails to provide unless an appropriate replacement or rescheduled lesson is supplied.
11. TECHNOLOGY
& ONLINE LEARNINGOnline tutoring requires suitable:
internet access;
computer, tablet or compatible device;
microphone and speakers or headphones;
camera where required; and
supported learning software or browser.
Parents are responsible for ensuring the student has reasonable access to the required technology.
Naijatutors cannot be responsible for interruptions caused solely by a student’s internet connection, device, electricity supply or local technical issue.
Where a significant technical failure is caused by Naijatutors or a platform used by us and materially prevents the lesson from being delivered, we will take reasonable steps to provide an appropriate remedy.
Students and parents must keep login credentials confidential and must not allow unauthorised persons to use their accounts.
12. STUDENT
& PARENT CONDUCTStudents must behave respectfully towards tutors, staff and other students.
Students must not:
bully, threaten or harass another person;
use discriminatory, abusive or sexually inappropriate language;
deliberately disrupt lessons;
share inappropriate material;
impersonate another person;
access another user’s account;
record or distribute classes without permission; or
use our learning platforms for unlawful purposes.
Parents are expected to support appropriate online behaviour.
Naijatutors may remove a student from a lesson where reasonably necessary to protect tutors, staff or other students.
Serious or repeated misconduct may result in suspension or termination of tutoring.
13. SAFEGUARDING
& COMMUNICATIONThe welfare and safety of children using Naijatutors services is important to us.
Tutors and staff are expected to maintain appropriate professional boundaries.
Parents should report safeguarding concerns promptly to Naijatutors.
Where we reasonably believe a child may be at risk of harm, we may take appropriate safeguarding action, including contacting:
the parent or guardian;
appropriate safeguarding professionals;
emergency services;
law-enforcement authorities; or
another appropriate authority.
Information may be disclosed without consent where disclosure is necessary or legally permitted to protect a child or another person.
Tutor/student communication should take place through approved channels wherever reasonably possible.
Parents should normally have appropriate visibility over administrative communication involving younger students.
14. PROGRESS
& ACADEMIC RESULTSNaijatutors may provide parents with information about student progress through:
session reports;
assessments;
tutor feedback;
progress reports; and
parent consultations.
We aim to help students improve their knowledge, academic skills and confidence.
However, we cannot guarantee:
a particular grade;
a particular examination score;
admission to a particular school;
a scholarship;
promotion to a particular academic level; or
any other specific academic outcome.
Results can depend on factors outside our control, including attendance, student effort, previous attainment, completion of assignments, school instruction and examination performance.
Nothing in this section limits our obligation to provide tutoring services with reasonable care and skill.
15. EXAMINATION
PREPARATIONWhere Naijatutors provides preparation for examinations such as GCSE, IGCSE, 11+, SAT, ACT, provincial, state or other examinations, parents remain responsible for checking:
examination eligibility;
registration requirements;
examination dates;
test-centre arrangements;
examination fees; and
current examination-board requirements.
Unless expressly stated otherwise, Naijatutors is an independent tutoring provider and is not affiliated with or endorsed by the relevant examination organisation.
16. LESSON RECORDINGS,
PHOTOS & TESTIMONIALSSome lessons, workshops or events may be recorded for appropriate purposes such as:
quality assurance;
safeguarding;
tutor development;
complaint investigation; or
educational review.
Where recording takes place, appropriate notice will be provided.
Marketing
Registering for tutoring does not automatically give Naijatutors permission to use a child’s:
photograph;
video;
voice;
testimonial;
identifiable schoolwork; or
lesson recording
for public marketing.
Where appropriate permission is required, we will obtain separate consent from the parent or guardian.
Refusing marketing consent will not prevent a student from receiving tutoring services.
Parents and students may not independently record, reproduce or publicly distribute lessons without permission.
17. EDUCATIONAL MATERIALS
& INTELLECTUAL PROPERTYEducational materials provided by Naijatutors or our tutors may include:
worksheets;
presentations;
lesson materials;
assessments;
exercises;
study guides;
recordings; and
other educational resources.
Unless otherwise stated, materials are provided for the student’s personal educational use only.
Materials must not be:
resold;
commercially distributed;
uploaded publicly;
reproduced as part of another tutoring service; or
otherwise used in a way that infringes intellectual property rights.
Naijatutors retains its rights in its branding, website content and original educational materials.
Students retain ownership of original work they create, subject to any applicable rights in materials incorporated into that work.
18. PRIVACYNaijatutors handles personal information in accordance with our Privacy Policy.
The Privacy Policy should be read together with these Terms.
Where consent is required for an optional use of personal information, such as certain marketing activities, accepting these Terms will not by itself constitute that separate consent.
19. COMPLAINTS, REFUNDS
& TERMINATIONIf you are dissatisfied with our service, please contact us promptly so that we can investigate and attempt to resolve the issue.
Depending on the circumstances, possible remedies may include:
investigation;
tutor feedback;
tutor replacement;
rescheduling;
class credit;
refund; or
another reasonable resolution.
Refund entitlement will depend on:
the service purchased;
whether tutoring has already been provided;
the timing and reason for cancellation;
applicable programme-specific terms; and
applicable consumer law.
We will not rely on a “non-refundable” term where doing so would be contrary to applicable law.
Suspension or Termination
Naijatutors may suspend or terminate services for serious or repeated reasons including:
persistent non-payment;
abusive behaviour;
serious misconduct;
safeguarding concerns;
fraud;
misuse of our systems; or
unlawful activity.
Except where immediate action is reasonably necessary, we will normally provide notice and an opportunity to address the issue.
If Naijatutors terminates tutoring where the parent or student is not at fault, prepaid amounts relating to services that will not be provided will be refunded or credited as appropriate.
20. LIABILITY & EVENTS
OUTSIDE OUR CONTROLNothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms removes any mandatory consumer rights.
Naijatutors is not responsible for losses arising solely from circumstances reasonably outside our control, such as:
major internet or telecommunications failures;
widespread power outages;
natural disasters;
government restrictions;
civil emergencies; or
comparable events.
Where such circumstances materially affect a lesson, we will make reasonable efforts to reschedule, provide an alternative or otherwise minimise disruption.
Our tutoring services are provided for personal educational purposes.
21. GOVERNING LAWThese Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, subject to mandatory consumer protections applicable in the country where the customer lives.
Nothing in these Terms is intended to remove legal or consumer rights that cannot lawfully be excluded.
If you are a consumer outside Ontario, you may have additional mandatory rights under the laws applicable to you.
22. CHANGES TO
THESE TERMSNaijatutors may update these Terms where reasonably necessary to reflect:
changes to our services;
operational changes;
technology changes; or
changes in applicable law.
The latest version will be published on our website with an updated revision date.
We will provide reasonable notice of material changes affecting an existing ongoing paid service where required.
We will not use changes to these Terms to retrospectively remove statutory consumer rights.

AGREEMENT
By registering for, purchasing or continuing to use Naijatutors Konnect tutoring services, you acknowledge that you have read and agree to these Terms & Conditions, subject to any statutory rights that apply to you.
